Welcome to The Spiral Bar. These Terms and Conditions govern your use of thespiralbar.com, purchases made through our website, market preorders, subscriptions, gift cards, event inquiries, and other services provided by The Spiral Bar.
By visiting our website, placing an order, joining a subscription, purchasing a gift card, or booking a service, you agree to these Terms and Conditions. If you do not agree, please do not use the website or place an order.
1. ACCEPTANCE AND ELIGIBILITY
By accessing this website or completing a purchase, you agree to these Terms and Conditions and all applicable policies. You must be at least 18 years old or have permission from a parent or legal guardian to make a purchase.
You confirm that the information you provide is complete and accurate and that you are authorized to use the selected payment method.
3. WEEKLY PREORDERS
Weekly preorders open Monday at 8:00 a.m. and close Wednesday at 10:00 p.m. for pickup that Friday, Saturday, or Sunday. Customers may place as many orders as they like during the preorder window.
Every completed and paid preorder will be prepared and fulfilled. Preorders do not have a quantity cap and do not sell out. Limited walk up inventory at farmers markets may sell out.
5. PICKUP RESPONSIBILITY
Customers must collect orders from the selected location during the stated pickup period. An order missed because the customer selected the wrong date or location is treated as a missed pickup.
A missed order will be held until that market closes. Any order remaining at closing is forfeited without refund or credit because it was prepared specifically for the customer.
7. PRODUCTS AND HANDMADE VARIATIONS
Weekly flavors, toppings, packaging, pickup locations, operating dates, and service options may change. Changes to future offerings do not affect completed and paid preorders.
Our products are handmade. Appearance, color, size, topping placement, and presentation may vary slightly from website photographs. Minor handmade variations and personal taste preferences are not product defects.
9. ALLERGENS AND FOOD SAFETY
Products may contain or contact milk, eggs, wheat and gluten containing ingredients, soy, peanuts, tree nuts, sesame, and other allergens. Products may be prepared with shared ingredients, utensils, surfaces, and equipment. We cannot guarantee an allergen free environment.
Customers with allergies, sensitivities, medical conditions, or dietary restrictions are responsible for reviewing available ingredient information and contacting us before ordering.
11. SPIRAL CLUB SUBSCRIPTIONS
The subscription is billed every four weeks. The first charge occurs on the upcoming Friday at 12:00 a.m. after purchase, and renewals occur every four weeks on Friday at 12:00 a.m.
Cancellation must be completed by Thursday at 11:59 p.m. immediately before the next renewal. A cancellation submitted after that deadline applies to the following billing period, and the current paid period continues.
Subscribers select weekly flavors during the Monday 8:00 a.m. through Wednesday 10:00 p.m. preorder window. If no flavors are selected, The Spiral Bar will choose them. A reminder email will be sent for pickup.
A subscriber may reschedule a box to another pickup day within the same weekend by requesting the change before 9:00 a.m. on the desired pickup date. If the entire weekend is missed, the box is forfeited without refund or credit.
13. EVENTS AND CATERING
Submitting an inquiry does not reserve a date. An event is confirmed only after The Spiral Bar approves the details, the customer accepts the applicable proposal or service agreement, required payment is received, and written confirmation is provided.
Deposits, cancellation deadlines, rescheduling, weather plans, final payment, guest count, customization, and other booking details are governed by the signed event agreement. If that agreement conflicts with these general Terms, the event agreement controls for that booking.
15. THIRD PARTY SERVICES AND AVAILABILITY
The website may use third party services for hosting, payments, analytics, scheduling, social media, and embedded content. Those providers may have separate terms and privacy practices.
We do not guarantee uninterrupted website availability. We may update, restrict, suspend, or discontinue website features when reasonably necessary.
17. CHANGES, SEVERABILITY, AND NO WAIVER
We may update these Terms to reflect changes to our services, operations, or legal obligations. The version posted on the website applies from its stated effective date.
If any provision is found invalid or unenforceable, the remaining provisions continue in effect. Failure to enforce a provision does not waive the right to enforce it later.
2. ORDERS AND PAYMENT
An order is confirmed after successful payment and delivery of an order confirmation. Customers are responsible for reviewing flavor selections, quantities, pickup date, pickup location, and contact information before checkout.
Prices, taxes, fees, flavor upgrades, and optional additions are displayed before checkout. We may correct obvious pricing or listing errors before fulfillment. If The Spiral Bar cancels a paid order, the customer will receive a full refund.
4. CHANGES AND CANCELLATIONS
Customers may request changes to flavors, quantities, pickup details, or cancellation through Thursday at 11:59 p.m. Preparation begins Friday at 12:00 a.m. Once preparation begins, the order is final and cannot be changed, canceled, or refunded.
A request is complete only after The Spiral Bar confirms it in writing.
6. ORDER INSPECTION AND PROBLEMS
Customers must inspect all items, quantities, and visible product condition before leaving the tent. Leaving the tent confirms that the order was received correctly and in acceptable visible condition.
If a problem could not reasonably have been discovered at pickup, contact hello@thespiralbar.com within 24 hours and include the order number, an explanation, and clear photographs when applicable. For an approved problem, The Spiral Bar will provide a replacement first. If a replacement is unavailable, store credit will be issued as a digital gift card emailed to the customer.
8. CANCELLATIONS BY THE SPIRAL BAR
We may cancel an order because of severe weather, illness, emergencies, ingredient shortages, equipment failure, obvious pricing errors, payment failure, suspected fraud, or circumstances outside our reasonable control. If The Spiral Bar cancels a paid order, the customer will receive a full refund to the original payment method.
10. STORAGE AND REHEATING
For food safety and best quality, refrigerate cinnamon rolls at 40°F or below within two hours of pickup, or within one hour when the surrounding temperature is above 90°F. Keep rolls covered and enjoy within three to four days.
For best enjoyment, remove the clear lid, transfer the roll to a microwave safe plate, heat for 15 seconds, then continue in five second intervals until warm. Avoid overheating. Do not microwave the branded bowl unless its packaging specifically states that it is microwave safe.
12. GIFT CARDS
Gift cards do not expire and do not carry fees. Gift card purchases are nonrefundable and are not redeemable for cash except where required by law.
Digital gift cards and store credits are delivered by email. The customer is responsible for providing a correct email address and safeguarding the gift card information.
14. WEBSITE USE AND INTELLECTUAL PROPERTY
The Spiral Bar name, exact logo, flavor names, photographs, copy, graphics, designs, packaging concepts, and website content are owned by or licensed to The Spiral Bar. They may not be copied, modified, distributed, sold, imitated, or used commercially without written permission.
You may not interfere with the website, attempt unauthorized access, upload harmful code, submit fraudulent information, impersonate another person, harass others, or use the website for unlawful purposes.
16. LIABILITY AND GOVERNING LAW
To the fullest extent permitted by law, The Spiral Bar is not responsible for indirect or consequential losses related to website use, delayed pickup, customer supplied information, or improper transportation, storage, handling, or reheating after pickup.
Nothing in these Terms limits rights or liability that cannot legally be limited. These Terms are governed by Tennessee law. When permitted by law, legal proceedings will be brought in a court with lawful jurisdiction in Davidson County, Tennessee.
